1. Purpose of This Policy

MySafeTherapy welcomes clients from across the world. This policy explains how our services work for international clients, what legal and professional boundaries apply, and how we handle your personal data in compliance with applicable laws. It is designed to protect both you (the client) and MySafeTherapy (the provider).

All services are delivered under recognised UK professional standards, including the BACP Ethical Framework.

2. Scope

This policy applies to any client accessing MySafeTherapy services from outside the United Kingdom, regardless of nationality.

3. Important Legal Notice

  • MySafeTherapy is registered and regulated in the UK.
  • Our therapists may not be licensed or registered in your country of residence unless stated.
  • By using our services, you agree that:
    • Services are provided under UK law.
    • MySafeTherapy is not liable for any breach of local laws that may occur if therapy services are restricted in your jurisdiction.
    • You are responsible for ensuring it is legal for you to access online therapy in your location.

4. Service Limitations

  • Not a crisis service – In an emergency, contact local emergency services (see Section 8 for resources).
  • Session times – Scheduled in UK time (GMT/BST).
  • Language – Sessions are conducted in English unless otherwise arranged.
  • Insurance coverage – If you wish to claim therapy costs via insurance, it is your responsibility to check eligibility with your provider before booking.

5. Data Protection & Privacy

  • For EU/EEA clients, we comply with EU GDPR in addition to UK GDPR.
  • For clients in other countries, we follow UK GDPR and apply equivalent safeguards where possible.
  • International transfers of your personal data will use recognised safeguards such as Standard Contractual Clauses (SCCs) or UK International Data Transfer Agreements (IDTAs).

6. Payments & Currency

  • All payments are processed in GBP (£).
  • Your bank or payment provider may apply exchange rates or fees — these are outside our control.
  • Invoices can be provided for insurance or tax purposes upon request.

Force majeure

MySafeTherapy is not liable for interruptions due to events outside our control, such as internet outages, political restrictions, or pandemics.

7. Confidentiality & Safeguarding

  • Your sessions are confidential in line with our UK legal obligations.
  • If you disclose that you are at immediate risk of harm to yourself or others, we may contact:
    • Local emergency services (if contact details are available), and/or
    • Trusted individuals you have nominated.
  • Our safeguarding procedures apply internationally, but in some cases, local emergency intervention may not be possible.

If local emergency services cannot be contacted, therapists will reach out only to nominated trusted contacts provided by you during onboarding. Child protection concerns will follow UK safeguarding protocols even for international clients.

8. Emergency & Crisis Support for International Clients

If you are in crisis or feeling suicidal, please contact local crisis services first:

MySafeTherapy cannot provide urgent intervention outside scheduled sessions.

Clients must confirm acceptance of this policy through a signed consent form before therapy begins.

9. Applicable Law & Jurisdiction

  • All services are provided under the laws of England and Wales.
  • Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

MySafeTherapy respects cultural differences in therapy, while adhering to UK ethical standards to guide practice.

10. Client Responsibility

By starting therapy with MySafeTherapy as an international client, you confirm that:

  • It is legal for you to receive therapy in your country.
  • You understand and accept the limitations described in this policy.
  • You will provide accurate information to ensure your therapist can work safely with you.

11. Policy Review

This policy will be reviewed annually or when international regulations or safeguarding laws change.

MySafeTherapy International Client Liability Waiver

1. Purpose of This Waiver

This waiver sets out the terms under which My Safe Therapy Ltd ("MySafeTherapy", "we", "our", "us") provides therapy services to clients located outside the United Kingdom ("international clients").

It is designed to limit our legal liability in relation to cross-border services and to ensure that you (the client) understand the limitations of our services in your jurisdiction.

2. Acknowledgement of UK Jurisdiction

By signing or accepting this waiver, you confirm that:

  • MySafeTherapy is a company registered and operating under the laws of England and Wales.
  • All services provided are delivered under UK law and professional standards.
  • Any disputes or claims arising from the services will be subject to the exclusive jurisdiction of the courts of England and Wales.

3. Licensing and Professional Regulation

  • Therapists delivering your sessions may be registered or accredited in the UK and may not be licensed in your country of residence.
  • You acknowledge that MySafeTherapy is not responsible for meeting the professional licensing requirements of your jurisdiction, unless explicitly stated in writing.
  • You accept that therapy is delivered according to UK professional and ethical standards.

4. Local Law Compliance

  • You are responsible for ensuring it is legal to access online therapy services from your location.
  • MySafeTherapy will not be held liable for any breach of local laws resulting from your use of our services.
  • If your jurisdiction prohibits or restricts remote therapy, you must inform us before commencing sessions.

5. Nature and Limitations of Service

You understand and agree that:

  • MySafeTherapy is not an emergency service.
  • Sessions are not a substitute for urgent medical or psychiatric care.
  • In case of crisis or imminent risk of harm to yourself or others, you must contact local emergency services or crisis support lines immediately.
  • We will make reasonable efforts to assist in safeguarding situations but cannot guarantee intervention through local services in your jurisdiction.
  • Where local emergency services cannot be contacted, MySafeTherapy may attempt to reach out only to the trusted individual(s) you nominated during onboarding. This ensures we can take limited safeguarding steps even if local authorities cannot be reached.

6. Data Protection and Transfers

  • Your personal data will be processed in accordance with UK GDPR and the Data Protection Act 2018.
  • If your data is transferred outside the UK/EEA, recognised safeguards such as Standard Contractual Clauses (SCCs) or UK International Data Transfer Agreements (IDTAs) will be applied.
  • Some local privacy laws may differ from UK law, and MySafeTherapy's obligations are based on UK standards.

7. Financial Transactions

  • All payments are processed in GBP (£).
  • You are responsible for any currency conversion fees or international banking charges applied by your provider.
  • Refunds, where applicable, will always be issued in GBP (£). Any differences in the final amount received due to currency fluctuations or bank exchange rates are outside MySafeTherapy's control.

8. Release of Liability

To the fullest extent permitted by law, you release, discharge, and hold harmless MySafeTherapy, its directors, employees, contractors, and therapists from any and all liability, claims, or demands arising from:

  • Differences in legal requirements or professional standards between the UK and your jurisdiction.
  • Restrictions, prohibitions, or enforcement actions by local authorities related to therapy services.
  • Any delay, failure, or inability to contact emergency or safeguarding services in your jurisdiction.

8a. Cultural Sensitivity

MySafeTherapy is committed to respecting cultural and personal differences in the delivery of therapy. While services are provided under UK ethical and professional standards, therapists will make reasonable efforts to understand and accommodate cultural contexts raised by clients during sessions.

9. Severability

If any provision in this waiver is found invalid or unenforceable, the remaining provisions will remain in full force and effect.

10. Acceptance of Terms

By signing below (or by clicking "I Agree" in the onboarding process), you confirm that you:

  • Have read and understood this waiver.
  • Understand the limitations of receiving therapy as an international client.
  • You provide explicit consent to receive services under UK standards.
  • Accept all terms outlined above.

MySafeTherapy Therapist Licensing Disclosure Policy

1. Purpose of This Policy

This policy ensures transparency around the professional licensing and accreditation of therapists providing services through MySafeTherapy.

It aims to:

  • Protect clients by clarifying the professional standards of their therapist.
  • Protect MySafeTherapy by limiting liability where cross-border licensing differences apply.
  • Ensure compliance with UK law, GDPR, and professional codes of ethics.

2. Scope

This policy applies to:

  • All therapists, counsellors, coaches, and mental health professionals providing services through MySafeTherapy.
  • All clients receiving therapy services from MySafeTherapy.

3. Our Licensing Standards

  • All therapists must hold a recognised professional qualification in counselling, psychotherapy, psychology, or a related field.
  • Therapists must be accredited, registered, or working towards accreditation with a recognised UK or equivalent professional body, such as:
    • British Association for Counselling and Psychotherapy (BACP)
    • UK Council for Psychotherapy (UKCP)
    • Health and Care Professions Council (HCPC)
    • British Psychological Society (BPS)
    • National Counselling & Psychotherapy Society (NCPS)
  • Proof of insurance and accreditation must be renewed annually or as required by MySafeTherapy's compliance team.

4. International Licensing Disclosure

  • MySafeTherapy operates under UK law and professional standards.
  • Therapists may not be licensed or accredited in the client's country of residence.
  • All clients are informed at onboarding that:
    • Therapy is provided according to UK licensing and ethical frameworks.
    • It is the client's responsibility to check whether using therapy from a UK-based provider complies with local regulations or insurance requirements.
  • Therapists may not claim to be "licensed" or "authorised" in jurisdictions where they do not hold professional registration.
  • International clients will be asked to review and electronically sign a disclosure form confirming their understanding of this limitation before therapy begins.

5. Therapist Disclosure Requirements

Therapists must disclose to MySafeTherapy and clients:

  • Their professional qualifications and awarding institution.
  • Their current licensing/accreditation body and membership number.
  • Whether they are licensed only in the UK, or also in other jurisdictions.
  • Any conditions, restrictions, or limitations on their practice imposed by their regulatory body.
  • All licensing and accreditation documents are stored securely in line with UK GDPR and MySafeTherapy's Data Protection Policy.

6. Client Awareness & Consent

  • Clients are informed of their therapist's licensing/accreditation status during onboarding.
  • For international clients, MySafeTherapy requires explicit acknowledgment that:
    • The therapist may not be licensed in the client's jurisdiction.
    • Services are provided under UK standards.
    • MySafeTherapy is not liable for differences in professional regulation.

7. Misrepresentation and Compliance

  • Therapists must not misrepresent their qualifications, licensing status, or professional affiliations.
  • Any therapist found to have falsified credentials will be immediately removed from the platform.
  • In serious cases, MySafeTherapy may also report the matter to the therapist's accrediting or regulatory body.
  • MySafeTherapy reserves the right to conduct verification checks with accrediting bodies.

8. Safeguarding and Ethical Standards

  • Regardless of jurisdiction, all therapists on the platform are expected to follow the UK ethical guidelines of their accrediting body (e.g., BACP Ethical Framework).
  • Safeguarding obligations (e.g., child protection, suicide risk intervention) apply as per UK standards, even when the client is located abroad.

9. Limitations of Liability

To the fullest extent permitted by law:

  • MySafeTherapy is not liable for conflicts between UK licensing and a client's local legal or regulatory requirements.
  • Clients accept responsibility for ensuring therapy is permitted in their location.
  • Any disputes arising from therapist licensing or disclosure will be governed by the laws of England and Wales.

10. Policy Review

This policy will be reviewed annually or when:

  • New therapists are onboarded from outside the UK.
  • Professional standards or licensing regulations change.

Reviews will also occur if insurer requirements or legal rulings affect therapist licensing or cross-border practice.

MySafeTherapy International Refund & Cancellation Policy

1. Purpose of This Policy

This policy explains how refunds and cancellations work for international clients using MySafeTherapy.

It ensures clarity for clients while protecting MySafeTherapy from disputes, payment gateway risks, and currency-related issues.

2. Scope

This policy applies to:

  • All clients booking sessions from outside the United Kingdom.
  • All therapy sessions, subscription plans, and packages purchased in GBP (£) via the MySafeTherapy platform.

3. General Conditions

  • All prices are listed in GBP (£).
  • Your bank or payment provider may apply exchange rates or transaction fees, which are outside MySafeTherapy's control and non-refundable.
  • Refunds will always be processed in GBP (£). Currency fluctuations between booking and refund dates may affect the final amount received.
  • All timing is calculated in UK time (GMT/BST). Clients are responsible for ensuring they understand how this relates to their local time zone.

4. Client Cancellations

a) Standard Therapy Sessions

  • More than 48 hours before session start → Full refund or free reschedule.
  • Less than 48 hours before session start → No refund. One-time reschedule permitted at therapist's discretion.
  • No-show (missed session) → No refund.
  • After two No-shows – therapist can decline all further sessions and/or MySafeTherapy may suspend your account.

b) Subscription Plans

  • Sessions must be used within the billing period.
  • Unused sessions cannot be carried forward after cancellation.
  • You may cancel at any time; cancellation takes effect from the next billing cycle.

c) Packages (e.g., 5 or 10 session bundles)

  • Packages are valid for 6 months from purchase date.
  • Partially used packages are refundable only for unused sessions, subject to the 24-hour cancellation rule.

5. Cancellations by MySafeTherapy or Therapist

If we or your therapist must cancel:

  • You will be offered a full refund or a reschedule at no extra cost.
  • If a therapist cancels more than twice within a two-month period, you can request either a reassignment.

6. Refund Processing

  • Approved refunds will be processed to your original payment method within 7–10 working days.
  • MySafeTherapy is not responsible for delays caused by banks, card providers, or international transfer systems.
  • Refunds will always be issued in GBP (£).

7. Exceptions (Non-Refundable Situations)

Refunds will not be provided if:

  • You fail to complete required onboarding or consent forms before a scheduled session.
  • You fail to attend a booked session (no-show).
  • Your local internet, device, or technical issues prevent access.
  • Your local laws restrict therapy access (clients are responsible for confirming legality before booking).
  • Exchange rate changes reduce the amount you receive in your local currency.

8. Exceptional Circumstances

At MySafeTherapy's discretion, partial or full refunds may be issued for:

  • Verified platform-wide technical failures.
  • Therapist misconduct (investigated and confirmed).
  • Safeguarding or emergency situations preventing a session.

9. Chargebacks & Disputes

  • Clients agree not to raise credit card chargebacks without first contacting MySafeTherapy to resolve the issue within 15 working days.
  • Any false or fraudulent chargeback claims may result in suspension of your account and legal action.

10. Governing Law

This Refund & Cancellation Policy is governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, regardless of the client's country of residence. This does not affect your statutory rights under applicable UK consumer protection law.

11. Policy Review

This policy will be reviewed annually, or sooner if international regulations, payment provider rules, or safeguarding requirements change.
