1. Introduction & Acceptance
These Terms and Conditions ("Terms") govern your use of the MySafeTherapy platform, including our website, web application, and associated services (together, the "Platform").
By creating an account, booking sessions, subscribing, or otherwise using MySafeTherapy, you confirm that you have read, understood, and agree to be bound by these Terms, along with our:
- Privacy Policy
- AI Policy
- User Guidelines
- Safeguarding Policy
- Complaints Handling Policy
If you do not agree to these Terms, you must not use the Platform.
2. About MySafeTherapy
MySafeTherapy Ltd operates a digital platform that provides:
- Access to independent, qualified therapists
- Digital wellbeing tools (journaling, mood tracking, worksheets)
- Optional AI-supported wellbeing features
Important:
MySafeTherapy is not a medical provider, emergency service, or crisis response service.
3. Eligibility
To use MySafeTherapy, you must:
- Be 18 years of age or older
- Have legal capacity to enter into a binding agreement
- Provide accurate and complete information
- Not be prohibited from using the service under applicable law
We do not provide services to minors.
4. Scope of Services & Limitations
4.1 Not an Emergency Service
MySafeTherapy does not provide:
- Crisis intervention
- Emergency monitoring
- Psychiatric diagnosis
- Medication management

If you are in immediate danger, you must contact emergency services (UK: 999, Samaritans 116 123).
4.2 Platform Role
MySafeTherapy acts as a technology platform facilitating access to independent therapists and digital tools.
Therapists:
- Are not employees or agents of MySafeTherapy
- Are solely responsible for the therapeutic services they provide
- Operate under their own professional and ethical obligations
5. Account Registration & Security
You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity conducted through your account
- Keeping your information accurate and up to date
You must notify us immediately if you suspect unauthorised access.
6. Therapy Services
6.1 Therapist Standards
All therapists are vetted prior to listing and are required to:
- Hold appropriate qualifications
- Be registered with a recognised professional body (e.g. BACP, UKCP, HCPC)
- Maintain professional indemnity insurance
6.2 Therapeutic Relationship
The therapeutic relationship exists solely between you and your therapist.
MySafeTherapy:
- Does not influence therapeutic decisions
- Does not supervise therapy content
- Is not liable for therapeutic outcomes
6.3 Session Conduct
You agree to:
- Attend sessions in a private, safe environment
- Not record sessions without explicit consent
- Respect professional boundaries
7. Digital & AI-Supported Tools
MySafeTherapy provides optional AI-supported features for reflection and wellbeing.
- AI tools are supportive only
- They do not provide diagnosis, treatment, or medical advice
- AI outputs must not be relied upon as a substitute for professional care
- You may opt out of AI features at any time
No significant decisions about your care are made solely by AI.
8. Subscriptions, Payments & Billing
8.1 Pricing
Prices are displayed at checkout and may vary by plan. All prices are in GBP and include VAT where applicable.
8.2 Billing
- Subscriptions renew automatically unless cancelled
- Payments are processed securely by third-party providers (e.g. Stripe)
8.3 Cancellation
You may cancel your subscription at any time via your account settings. Cancellation takes effect at the end of the current billing period.
Nothing in this section affects your statutory consumer rights.
8.4 Session Credits
- Session credits are subject to plan terms
- Unused sessions do not roll over unless explicitly stated
9. Cancellations & No-Shows
- Sessions must be cancelled or rescheduled at least 24 hours in advance
- Late cancellations or no-shows may result in the session being counted as used
- Repeated missed sessions may result in access review
10. Acceptable Use
You must not:
- Harass, abuse, or threaten others
- Discriminate or use hateful language
- Share account access
- Misuse AI tools
- Attempt to gain unauthorised system access
- Use the platform for unlawful or commercial purposes
11. Safeguarding & Confidentiality
Therapy communications are confidential. However, confidentiality may be limited where:
- There is a serious risk of harm to you or others
- Safeguarding obligations arise
- Disclosure is required by law or court order
MySafeTherapy reserves the right to restrict access where necessary to protect safety.
12. Intellectual Property
All platform content, software, branding, and features belong to MySafeTherapy or its licensors.
You retain ownership of personal content you create but grant us a limited licence to store and process it solely to provide the service.
We do not use identifiable therapy content to train general-purpose AI models without explicit consent.
13. Suspension & Termination
We may suspend or terminate your account if:
- These Terms are breached
- There are safeguarding concerns
- Misuse or harm is identified
Upon termination:
- Access to the platform ceases
- Data retention follows our Privacy Policy
14. Limitation of Liability
To the fullest extent permitted by law:
- MySafeTherapy is not liable for therapeutic outcomes
- We are not responsible for service interruptions beyond our control
- Total liability is limited to fees paid in the previous 12 months
Nothing excludes liability that cannot legally be excluded.
15. Indemnity
You agree to indemnify MySafeTherapy against losses arising from:
- Breach of these Terms
- Misuse of the platform
- Unlawful conduct
16. Complaints & Dispute Resolution
We encourage informal resolution first.
We aim to:
- Acknowledge complaints within 5 working days
- Respond within 28 days
If unresolved:
- Therapy complaints may be escalated to the therapist's professional body
- Data concerns may be raised with the UK ICO
Disputes are governed by the courts of England and Wales unless mandatory consumer protections apply.
17. Consumer Rights
Nothing in these Terms affects your rights under:
- Consumer Rights Act 2015
- Applicable consumer protection laws
18. International Users
If you access the platform outside the UK:
- Local mandatory consumer rights may apply
- UK law governs these Terms where permitted
19. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated in advance where required.
Continued use after changes indicates acceptance.
20. Severability
If any provision is found unenforceable, the remainder will continue in effect.
21. Governing Law
These Terms are governed by the laws of England and Wales.
